Guest Conditions
1. Applicability: These general conditions apply to all reservations and stays in the rented apartment, managed by Mi Alegría (the "local host"). Payment is made directly to the apartment owner (the "owner").
2. Reservation and Payment: The reservation is only final after written confirmation and receipt of payment or advance payment as stipulated in the contract. Payment is made directly to the host according to the agreed terms. If payment is not made on time, the local host may cancel the reservation.
3. Cancellation and Changes: Cancellations must be made in writing. The following fees apply:
– Up to 12 weeks before: 10% of the total amount.
– Between 12 and 6 weeks before: 50%.
– Less than 6 weeks: 100%.
In case of no-show or early departure, 100% will be charged. Changes are subject to availability and may incur additional fees.
4. Liability and Damages: The guest must make proper use of the apartment and report any damage to the host. Damages will be claimed from the guest. Neither the host nor the owner are responsible for loss, theft, or disturbances caused by construction or neighbors.
5. House Rules: The maximum number of guests cannot be exceeded. Pets and smoking are not allowed inside. Rest must be respected and no disturbance to third parties must be caused.
6. Complaints and Disputes: These must be reported to the local host. Spanish law will apply, and any disputes will be resolved by the courts of Malaga.
7. Other: The host may refuse guests or cancel the stay if these terms are violated. By booking, the guest agrees to these terms.
Terms and Conditions for Owners
1. Definitions: Owner: the person who contracts the services of the host.
Host: Mi Alegría, Camino de la Raja 71, 29120 Alhaurín el Grande.
Vacation Home: property rented to guests.
Guests: those who rent the property.
Agreement: contract between host and owner for the provision of services.
2. Host Services: Key collection, check-in/check-out, post-stay cleaning, damage inspection and reporting, guest service, and emergency assistance, as agreed.
3. Owner Obligations: Maintain the property in good condition and in compliance with regulations. Provide accurate information. Maintain necessary insurance. Cover guest damages. Provide the host with access to services. Provide cleaning products. Cover the costs of materials and spare parts.
4. Fees and Payments: Services are quoted in advance. Payment is due within 7 days of the invoice. In the event of a delay, the host may suspend the service.
5. Host Responsibilities: The host is not liable for damages due to force majeure.
6. Liability: The host is not responsible for damage to the property, loss/theft, guest conduct, or misuse of the property.
7. Force Majeure: In the event of force majeure (disasters, pandemics, etc.), the host may suspend or cancel the service without compensation.
8. Term and Termination of the Contract: Either party may terminate the contract with two months' notice. Upon termination, the host must return the keys and belongings to the owner within 5 days. The contract may be terminated immediately if there is a breach.
9. Modifications: The host may modify the conditions. These will be published on the website and the owner will be notified.
10. Applicable Law and Jurisdiction: Spanish law applies. Any dispute will preferably be resolved by agreement between the parties. If this is not possible, the courts of Malaga will be consulted.
